The Supreme Court (SC) on Wednesday (July 23) dismissed an appeal by Kalanithi Maran-backed Kal Airways seeking ₹1300 crore in damages from SpiceJet. The apex court upheld a previous Delhi High Court’s order that had rejected Kal Airways’ claim.

Kal Airways had approached the SC contesting the Delhi High Court’s dismissal of its damages claim against the airline. Kal Airways and SpiceJet have been embroiled in a long-standing promoter dispute since 2015. The Delhi HC on May 23, rejected Kal Airways’ claim, calling it a “calculated gamble” and citing “deliberate and wilful concealment of facts.”
Earlier, an arbitral tribunal had also rejected Kal Airways’ ₹1,300 crore damages claim against the airline.
In May 2024, KAL Airways and Kalanithi Maran announced that they would seek damages of over ₹1,323 crore from SpiceJet and Ajay Singh. This was in addition to the pending dues of ₹353.50 crore that they had sought.
