The United Kingdom’s top court on Wednesday upheld an appeal by a campaign group on whether transgender women are legally women under equality legislation, ruling that the law referred to a “biological woman and biological sex”.Whether a trans woman with a gender recognition certificate (GRC), a formal document that legally recognises someone’s new gender, is protected from discrimination as a woman under the country’s Equality Act was the subject of a Supreme Court ruling.
This comes to pass at a time when organisations like Women Scotland (FWS) have advocated that women’s rights should only apply on the basis of a person’s biological sex.
The group challenged guidance issued by the Scottish government over a 2018 law that was meant to increase the proportion of women on public sector boards.This law meant that trans women with a gender recognition certificate (GRC) were legally deemed women.
